Terms of Service
Last updated: 29 September 2026
These terms are an agreement between you and iddesign Ltd, a company based on the Sunshine Coast, Queensland ("we", "us", "our"). They cover your use of Make Safer, our online software for creating, storing and sharing health and safety records (the "Service").
By creating an account or using the Service, you agree to these terms. If you are signing up for a business, you confirm that you are authorised to accept these terms on its behalf, and "you" includes that business.
1. What Make Safer is, and what it is not
Make Safer is a record-keeping tool. It helps you turn your health and safety paperwork (such as SWMS, hazard registers, incident reports, procedures and site forms) into digital records that your team can fill in, sign and find in one place.
Make Safer is not a health and safety service. In particular:
- We do not provide legal, work health and safety, or other professional advice.
- We do not assess your workplace, your risks or your controls.
- We do not check whether your documents are complete, accurate or compliant with any law, code of practice or standard.
- We do not notify any regulator on your behalf. Where the Service flags an incident as possibly notifiable, that is a prompt for you to review. Deciding whether to notify, and doing so, is your responsibility.
Any templates, examples, suggested wording, risk ratings or prompts in the Service are general starting points only. You must review and adapt them to your own work and workplace.
2. Your responsibilities
You remain solely responsible for:
- meeting your obligations under the work health and safety (or occupational health and safety) laws that apply to you, in every state or territory you work in;
- the content of every record you create, and the decisions you make using the Service;
- choosing the correct state or territory setting for your business;
- keeping your records for as long as the law requires you to (see section 8);
- making sure the people whose information you enter into the Service (such as workers, contractors and visitors) have been told about it, as required by privacy law;
- who you invite to your account, the roles you give them, and removing people who should no longer have access; and
- keeping your login details secure and telling us promptly if you believe your account has been accessed without permission.
Where you seek professional advice about your health and safety obligations, you should get it from a qualified adviser.
3. Accounts
You must give accurate information when you sign up and keep it up to date. Each person using the Service needs their own login. You are responsible for everything done through your account.
4. Free trial
New company workspaces start with a free trial, usually 14 days. We may extend a trial on request, up to one month in total, at our discretion. At the end of the trial, you will need a paid plan to keep creating new records.
5. Plans, billing and cancellation
- Paid plans are billed monthly or yearly in advance, at the price agreed when you subscribe. Prices are in Australian dollars and include GST where applicable.
- Payments are processed by our payment provider, Stripe. We do not store your full card details.
- You can cancel at any time. Cancellation takes effect at the end of your current billing period, and you keep access until then.
- Fees are non-refundable, including for part-used periods and for yearly plans cancelled early, except where the law requires a refund.
- We may change our prices with at least 30 days' notice. The new price applies from your next billing period after the notice.
- If a payment fails, we may restrict your account until it is paid.
6. Your content
You own the records, documents, photos, signatures and other content you put into the Service ("your content"). You give us permission to store, copy, display and process your content only as needed to provide, secure and support the Service for you.
You must not upload content that you do not have the right to use, or that is unlawful, harmful or infringes someone else's rights.
Our handling of personal information is explained in our Privacy Policy.
7. Acceptable use
You must not:
- use the Service for any unlawful purpose;
- try to access another business's data, or parts of the Service you are not permitted to use;
- interfere with, overload or try to break the security of the Service;
- copy, resell or reverse engineer the Service; or
- share your login with anyone else.
We may suspend or close an account that breaches these terms.
8. Keeping your records
Some laws require you to keep certain records, such as incident records, for a set period (often five years or more). Make Safer is not an archive service, and it is your responsibility to keep your own copies of any record you are required to retain. Records can be printed or saved as PDF from within the Service.
After your subscription ends, we keep your data for up to three years so that it can be restored if you return, and then delete it. You can ask us to delete it sooner by contacting us (see section 14). We do not currently offer a bulk data export.
9. Availability and changes
We work to keep the Service available and reliable, but we do not promise that it will be uninterrupted or error-free. We may carry out maintenance, and we may change, add or remove features from time to time. If we make a change that significantly reduces what your paid plan includes, we will tell you in advance.
10. Australian Consumer Law
Nothing in these terms excludes, restricts or modifies any right or remedy you have under the Australian Consumer Law or any other law that cannot lawfully be excluded. Where our liability for failing to meet a consumer guarantee can lawfully be limited, it is limited to supplying the Service again or paying the cost of having it supplied again.
11. Limitation of liability
To the extent permitted by law:
- the Service is provided "as is", and we give no warranty that it is suitable for any particular purpose, or that using it will make you compliant with any law;
- we are not liable for any injury, illness, death, property damage, fine, penalty, prosecution or claim arising from your work, your workplace, your health and safety practices or your records;
- we are not liable for any indirect or consequential loss, or any loss of profit, revenue, data or opportunity; and
- our total liability to you for all claims relating to the Service is limited to the fees you paid us in the 12 months before the claim arose.
12. Indemnity
To the extent permitted by law, you indemnify us against any claim, loss or cost (including reasonable legal costs) arising from your content, your use of the Service, or your failure to meet your health and safety or legal obligations.
13. Changes to these terms
We may update these terms from time to time. We will post the updated terms on this page and change the date at the top. If a change is significant, we will let account owners know by email or in the app. By continuing to use the Service after a change takes effect, you accept the updated terms.
14. Contact and governing law
Questions about these terms can be sent to Charles@iddesign.net.au.
These terms are governed by the laws of Queensland, Australia. You and we submit to the non-exclusive jurisdiction of the courts of Queensland.
